End User License Agreement

This agreement is between you (the “licensee”) and Fair Lab (“we”, “us”), the vendor of the SketchUp extensions Fair Align and Fair Space (the “software”). By installing or using the software you accept these terms. If you do not accept them, do not install or use the software.

1. What you get

We grant you a perpetual, non-exclusive, non-transferable licence to install and use the software for your own work, personal or commercial. The licence is single-user: it is granted to one named user, who may install the software on the machines they personally use — for example a desktop and a laptop — provided they are the only person using it. A separate licence is required for each additional user.

A 30-day free trial is available before purchase. The trial is the same software under the same terms, limited in time.

2. Purchase and payment

The software is sold through the SketchUp Extension Warehouse for a one-time price of USD 10 per extension. There is no subscription and no recurring fee. Payment, invoicing and licence delivery are handled by Trimble through the Extension Warehouse, under Trimble's own terms — we are not a party to that payment transaction.

Purchases made in the Extension Warehouse are non-refundable under Trimble's policy. The 30-day trial exists so you can confirm the software does what you need before you buy. Statutory rights that cannot be waived under the law that applies to you are unaffected by this paragraph.

3. What you may not do

  • Redistribute, resell, sublicense, rent, lend or publish the software or any part of it, whether or not for payment.
  • Share your licence, licence key or account credentials with anyone else.
  • Decompile, disassemble, deobfuscate or otherwise attempt to derive the source of any part of the software that is not distributed in readable form, except to the extent that applicable law expressly permits it despite this restriction.
  • Remove, alter or obscure any copyright, licence or attribution notice in the software.
  • Modify the packaged extension and distribute the result, or incorporate the software into another product.

Models, drawings and any other work you produce using the software are entirely yours. We claim no rights in them.

4. Ownership

The software is licensed, not sold. We and our licensors retain all ownership of the software and of all intellectual property rights in it. You get the rights set out in section 1 and nothing more.

5. Privacy

The software runs entirely on your own machine. It makes no network requests and collects no data about you or your models. See our privacy page for details. Licensing and purchase are handled by Trimble through the Extension Warehouse and are covered by Trimble's privacy terms, not ours.

6. Updates and availability

We may release updates from time to time, distributed through the Extension Warehouse. Updates to a version you have licensed are provided at our discretion; nothing here obliges us to produce updates, support any particular version of SketchUp indefinitely, or keep the software on sale.

7. No warranty

The software is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the software will be uninterrupted or error-free, or that it will meet your requirements. You are responsible for keeping backups of your models and for checking the results of any operation before you rely on them.

8. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, models, profit, revenue or business, arising out of or in connection with the software or this agreement, however caused and on any theory of liability. Our total aggregate liability for all claims relating to the software is limited to the amount you actually paid for the licence in question.

Nothing in this agreement excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

9. Termination

This licence lasts until terminated. It terminates automatically if you breach any of its terms. On termination you must stop using the software and remove it from your machines. Sections 3, 4, 7, 8 and 10 survive termination.

10. Governing law

This agreement is governed by the laws of Bulgaria, without regard to its conflict-of-law rules, and the courts of Bulgaria have exclusive jurisdiction over any dispute arising from it. Mandatory consumer-protection rules of the country where you live continue to apply to you regardless of this clause.

11. The whole agreement

This agreement is the entire agreement between you and us about the software and replaces any earlier understanding. If a court finds any provision unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. We may update these terms for future versions of the software; the version published here when you install a release governs that release.
